Minnesota State law regulates the sale and possession of alcohol. Businesses or organizations wishing to sell or serve beer, wine and alcohol must be approved by the City. The City of Stillwater provides licenses for the following types of liquor: On-Sale, Off-Sale, Wine (with strong beer), 3.2 On-Sale, 3.2 Off-Sale, Sunday Sales, 2 A.M. Sales, Temporary On-Sale Liquor License, Micro Distilleries, and Brew pub licenses.

How to Apply

All new liquor license applicants must submit the following (except Temporary Liquor Licenses).

- Part 2 – Personal History Statement (one for each person)
State Application(s)
City fees and AGED Fees (if applicable)

The license period is from January 1 through December 31. Submit all application materials and fees 60 days prior to when you desire to start serving liquor to the City Clerk.

State Applications

Submit the state application(s) you wish to apply for with your city application. Some applications are used for multiple licenses. Description of licenses.

Retailer’s (Buyer’s) Card – used to purchase Liquor/Wine – Applicant sends this form and fee directly to the State. The City does not have these cards and does not process them. Your state Buyer’s card is not your license to sell liquor, it is only to purchase the liquor.

Fees

Liquor licenses are renewed yearly and nontransferable. Makes checks payable to the City of Stillwater or call City Hall to pay with credit card. *If you are applying for a On-Sale Intoxicating license that is less than the 12-month period, some of the license fees may be prorated.

Renewal Process

The City will send a renewal letter to all liquor license holders licensed by the City of Stillwater. The applicant is responsible to submit the correct forms and fees by the due date. Completed renewal application packets must be submitted by November 1 to be completed by December 31 annually. Some applications (2 am and consume/display) have different renewal dates (see above) and are sent directly from the State.

Liquor Liability Insurance

Insurance documentation cannot be a “insurance declaration”, “binder”, or quote. It must be a Certificate of Liability Insurance. The Certificate must match exactly with the licensee name given on the application. If your application lists the business name as his or her own name, followed by a dba name, the insurance must list both licensees’ name and dba name. The Certificate must also show coverage for the entire license period – January thru end of December, or state “continued until canceled” on the Certificate. If your liquor license is exempt from insurance per Minnesota Statute 340A.409 subd. 4, you must submit an Affidavit of Sales to the City Clerk.

License Process

Licenses are processed by the City Clerk, background investigations are completed by the Stillwater Police Department and then the application is presented to City Council for approval. The City Clerk will submit your State applications to Minnesota Department of Public Safety Alcohol and Gambling Enforcement Division (AGED) for review and approval. The process is complete when the city license is issued by the City Clerk.

Inspections of premises by Fire and Building Inspections need to occur before license is approved. Applicant is responsible for scheduling appointments. Contact Fire Marshal at (651) 351-4950 and Building Official at (651) 430-8825.

Server training is required for all new applicants. Contact the Stillwater Police Department at 651-351-4900 for more information. Washington County Public Health and Environment's Office conduct alcohol and tobacco check compliance training as well.
